Terms and conditions



These terms and conditions will govern the relationship between subscribers and SEALINK. These terms and conditions are to be read before the customer enters a subscribtion.

1. Subscriber terms
These terms are binding for all subscribers, both short term subscribers (1 hour, 2 hours, 24 hours and 1 single month) and current 3 month subscribers provided by SEALINK wireless connection. After signing up, the customer will receive a receipt by e-mail.

2. The parties
By establishing a subscription the agreement is valid between the customer and  SEALINK. Users of  SEALINK services must be at least eighteen years old or have the consent of their parents or legal guardians. The customer is bound by this agreement and payment of the chosen subscription. By entering a 3 months subscription the customer has 14 days right of refusal from the receipt date.

3. Subscriber agreement
By entering the agreement the customer is required to state name and valid e-mail address (the receipt will be sent to this e-mail address). When entering a 3 month subscribing plan address and phone number is also required. The subscription gives the right to surf the Internet in the chosen period. The subscription does only function at one PC at the time and it is illegal to share or transfer the subscription. This will automatically block the current subscriber.

4. Security
By entering the agreement the customer is required to chose a user name(login) and a password. This information is confidential and strictly personal. The customer is responsible for 3. parties abuse of this information. The customer pay attention to the fact, that by downloading files from the Internet or by opening e-mails the customer is exposed to a risk in terms of viruses, worms and other potential damage to software and hardware. SEALINK wireless connection do not have any influence on these damages and can not be held responsible for any damage or loss.

5. Dependability
The customer is not allowed to exceed the chosen subscription.
The special terms and conditions of Internet access provides a potential uncertainty in terms of speed and access time. If the speed in certain cases is lower than expected  SEALINK does not compensate the customer. SEALINK wireless connection reserves the right to minimize/lower/cut the stated locations as a result of technical difficulties or security problems.

6. Prices
The subscription prices are depending on the chosen kind of subscription. SEALINK wireless connection is charging the subscription fee online by online credit card payment or by PIN card voucher on selected locations . SEALINK wireless connection can furthermore charge specific taxes and charges for additional services, functionalities e.t.c.

7. Payment
Payments in relation to the subscriber agreement are made in advance by credit card (Dankort, VISA, Mastercard , MAESTRO, VISA Electron, JCB). All prices are in DKK. The customer receives a receipt directly by e-mail. If payments are overdue SEALINK wireless connection will charge fees according to “the Danish National Banc interest fees”.  SEALINK is also entitled to charge service fees. If SEALINK wireless connection transfers overdue payments for debt collection, additional charges will be added.

8. Use of the Internet
The customer is responsible for all information which are received using  SEALINK Internet access.
If the customer via the Internet are i.e. buying online products and services or surfing illegal websites, this is solely done without any lawful relation/participation to SEALINK wireless connection.

9. Liability
 SEALINK has no liability for loss related to delayed connections, disconnections e.t.c.  SEALINK is never liable for direct or indirect loss of data, software e.t.c. SEALINK wireless connection is furthermore not liable to criminal access via customers’ computers or other hardware/software. SEALINK wireless connection is not liable to “force majeure” damages i.e. general hardware failures, weather damages, war e.t.c.

10. Termination
Termination of short term subscriptions (1 hour, 2 hours, 24 hours, 1 month) is not possible due to the limited time period. Terminations of pending 3 month subscriptions are bound of the following terms:
3 month subscriptions are no terminable the first 3 months. Hereafter the subscription can be terminated with 30 days notice. If the subscription is not terminated within 30 days this will continue until it is terminated according to the above terms. SEALINK wireless connection can terminate the subscription with 30 days notice. Termination can be done by letter or e-mail. Prepaid subscriptions are non-refundable.

11. Violation of subscription terms If the customer is violating the terms, SEALINK wireless connection are entitled to disconnect the customers access. The following are considered as reasons to disconnect access: The customer is not paying (over)due subscription fees, the customer is involved in crime by using the Internet i.e. “spamming”, distributing viruses e.t.c., the customer is violating Danish law, hereunder copyrights. If  SEALINK terminates the connection due to the above, no refund is made. Customers who have financial out standings with SEALINK wireless connection, can not sign up for new subscriptions, before the debt has been fully paid.

12. Change of terms and prices
Minor changes of these subscription terms, services and changes/potential service fees are posted on our website (http://www.hotspot.sealink.dk) 30 days prior to implementation. If price regulations are subject to changes in tax and V.A.T., the changes will be effective without notice. Changes of other prices will be effective upon posting at our website. Changes which benefit the customer will be effective without notice;

13. Complains, venue and statutory.
SEALINK wireless connection are receiving written complains. If both parties agree on these complains, full or partial refunding will be made. Any dispute between the parties, which can not be solved, is to be solved by the court in Copenhagen. Danish law is to be followed in court.

14. Commencement
These terms are valid per 1. of January 2006. Subject to misprints and price changes.
